Prior counsel lost the trial - a complete victory for the defendants. Rob Rickner took over the case, and won the appeal, based on a fatal defect in the jury instructions that allowed the defense to argue the detective's lie was somehow a typo. The Second Circuit awarded a new trial in a published decision in 2021.

At the re-trial, the jury found that the detective fabricated evidence to wrongfully prosecute Ashley, and awarded him punitive damages for the reprehensible conduct.
